Last Updated: September 24, 2026

Welcome to Niusha Gallery.

These Terms and Conditions (“Terms”) govern your use of the Niusha Gallery website and your participation in our classes, workshops, camps, events, private parties, corporate events, and other services.

By using our website or purchasing or registering for our services, you agree to these Terms.

If you register a child or minor for a Niusha Gallery program, you represent that you are the child’s parent or legal guardian or otherwise have the legal authority to complete the registration and agree to these Terms on the participant’s behalf.

1. Services

Niusha Gallery provides artistic and educational experiences, including art classes, children’s and teen programs, camps, workshops, Sip & Paint events, private parties, corporate events, exhibitions, and artwork sales.

Program descriptions, schedules, locations, instructors, prices, materials, and availability may change from time to time.

Niusha Gallery reserves the right to make reasonable changes to programs when necessary.

2. Registration

Certain classes and events require advance registration.

You agree to provide accurate and complete information when registering for a class, camp, workshop, event, or other service.

A registration is considered confirmed only after completion of the applicable registration and payment requirements.

Class and event spaces may be limited and are available on a first-come, first-served basis unless otherwise stated.

3. Registration of Minors

A parent or legal guardian must be responsible for registering a minor participant.

By registering a minor, the parent or legal guardian confirms that the information provided to Niusha Gallery is accurate and that they have authority to provide the information and permissions necessary for the minor’s participation.

Parents and legal guardians should inform Niusha Gallery of relevant information that may reasonably affect a child’s participation or safety.

4. Participant Conduct

Participants are expected to:

  • Follow reasonable instructions from instructors and staff
  • Treat instructors, staff, guests, and other participants respectfully
  • Follow applicable safety rules
  • Use art supplies, equipment, and facilities appropriately
  • Follow the rules and requirements communicated for the applicable class or event

Niusha Gallery may restrict or end a participant’s participation if their conduct creates a safety concern, materially disrupts a program, or creates an inappropriate environment for other participants.

5. Photography and Video

Niusha Gallery may photograph and record video during classes, camps, workshops, private events, corporate events, exhibitions, and other activities.

Photographs and recordings may be used for business, promotional, advertising, marketing, social media, website, and educational purposes when appropriate consent has been obtained or when otherwise permitted by applicable law.

Photography and video involving minors will be handled in accordance with applicable law and Niusha Gallery’s Privacy Policy.

Where consent is required, parents or legal guardians will be provided with an appropriate consent or opt-out mechanism.

Participation in a Niusha Gallery program will not be conditioned on optional promotional photography consent unless otherwise permitted by applicable law and specifically communicated to the participant or parent/legal guardian.

6. Marketing Communications

Niusha Gallery may send service-related communications regarding registrations, purchases, classes, events, schedule changes, cancellations, and reminders.

Where required by applicable law, promotional communications will be sent only after obtaining the appropriate consent.

Promotional communications may include information about:

  • Upcoming classes and workshops
  • Camps
  • Events
  • Private events
  • Promotions and special offers
  • New programs and services
  • Other Niusha Gallery activities

Recipients may opt out of marketing communications in accordance with the instructions provided in the applicable communication.

Opting out of marketing communications does not prevent necessary transactional or service-related communications.

7. Payments

Prices and payment requirements are presented during the applicable registration or purchase process.

Payments may be processed through third-party payment providers.

By submitting a payment, you authorize the applicable payment provider to process the transaction.

Niusha Gallery is not responsible for errors or outages caused solely by third-party payment systems.

8. Cancellations, Refunds, and Rescheduling

Cancellation, refund, and rescheduling policies may vary by class, camp, event, private party, or purchase.

Any specific cancellation or refund policy provided during registration or purchase will apply to that transaction.

Niusha Gallery may cancel or reschedule a class or event when reasonably necessary.

If Niusha Gallery cancels or materially changes an event, we will make reasonable efforts to notify registered participants and provide any refund, credit, or rescheduling options that are applicable under the circumstances and the applicable event policy.

9. Artwork and Intellectual Property

Niusha Gallery’s website, branding, logos, written materials, photographs, graphics, instructional materials, artwork, and other content are protected by applicable intellectual property laws.

Except where expressly permitted, you may not reproduce, distribute, modify, publish, sell, or commercially exploit Niusha Gallery’s copyrighted materials, artwork, branding, or other proprietary content without prior written permission.

Artwork created by participants during classes or events remains subject to any specific ownership or use terms communicated for the applicable program.

The use of third-party services may be subject to the third party’s own terms and policies.

Niusha Gallery is not responsible for the availability, security, content, or practices of third-party services that it does not control.

12. Participant Safety and Assumption of Risk

Participation in art classes, camps, workshops, and events may involve ordinary risks associated with creative activities and the use of art supplies, tools, furniture, food, beverages, or other materials.

Participants are expected to follow reasonable safety instructions provided by Niusha Gallery staff.

Parents and legal guardians are responsible for determining whether a particular program or activity is appropriate for their child and for communicating relevant information to Niusha Gallery.

Nothing in these Terms is intended to waive or limit any right or protection that cannot legally be waived or limited under applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Niusha Gallery will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the website or participation in our services.
